Island Cuisine – Terms and Conditions Agreement

1. Force Majeure

1.1. Client acknowledges that events such as storms, utility interruptions, natural disasters, pandemics, and Territory/State relocations are beyond Island Cuisine’s control. Rescheduling may be necessary without liability.

2. Payments and Refunds

2.1. All sales are final. Payments are non-refundable but may be converted into transferable credit for approved Island Cuisine services.

2.2. Payment Options:

 2.2.1. Option 1 – Full Payment is required for all Platter To-Go Orders, Plated Meals, Bereavement Full Catering Services, and may also apply to any Full-Service Catering.

 2.2.2. Option 2 – 50% Deposit is available only for Full-Service Catering. The remaining balance must be paid in full at least 72 hours prior to the event. If unpaid, Island Cuisine will only prepare food for the number of guests covered by the deposit.

3. Guest Guarantees and Overages

3.1. Final guest count must be confirmed at the time of booking.

3.2. Island Cuisine is only required to serve the confirmed amount. Any overages will be charged to the client.

3.3. Tentative bookings will be held for 48 hours before being released or canceled.

4. Function Discrepancies and Quality Assurance

4.1. Any concerns or discrepancies must be reported within 24 hours after the function.

4.2. Resolutions, reimbursements, or credits will be addressed within 15 calendar days of notification.

5. Food and Beverage Policies

5.1. Outside food must be declared in advance. Island Cuisine is not responsible for or required to service food or beverages brought in by guests.

5.2. If additional protein is added to the buffet, corresponding starch must be ordered.

5.3. Clients must provide extra paper goods and utensils for any outside food not serviced by Island Cuisine.

6. Conduct and Service Refusal

6.1. Island Cuisine reserves the right to remove or deny service to any person without liability.

6.2. Clients must ensure all event activity complies with Guam law and Island Cuisine regulations.

6.3. Island Cuisine may refuse service to any attendee who is belligerent, abusive, non-cooperative, or violent.

7. Additional Services and Charges

7.1. Any added services or accommodations outside this agreement must be paid immediately upon billing.

7.2. Island Cuisine does not service outside food, but donated outside food may be allowed at a separate table if provided by the client.

7.3. Island Cuisine will not provide additional paper goods or beverages once the guaranteed count has been met.

8. Responsibility and Liability

8.1. Island Cuisine is not responsible for instruments, personal items, or equipment left behind at the venue.

8.2. Service must begin on time. Overtime incurred beyond the 4-hour max service window will be charged.

8.3. Clients must provide food storage containers, foil pans, and beverage igloos as needed.

8.4. An appointed event representative must audit and confirm the condition of all leftover food.

8.5. Once food is delivered and received by the designated event representative, Island Cuisine is released from any liability.

9. Image Use Permission

9.1. Island Cuisine is authorized to use event images for marketing, display, contests, and promotional purposes unless otherwise requested in writing.

10. Governing Law

10.1. This agreement is governed by the laws of Guam.
